La Persona en el Derecho Romano: Más que Solo Existir

Imagínate vivir en una época donde simplemente nacer no te garantizaba derechos legales. En Roma, la persona física no era solo cualquier individuo - tenías que cumplir requisitos específicos para ser considerado una verdadera persona ante la ley.

La palabra "persona" viene de "personare", que significaba máscara o rostro humano. Esto ya nos dice algo: en Roma, tu identidad legal era como una máscara que no todos podían usar.

Para tener personalidad jurídica completa, necesitabas tres cosas esenciales: el Status Libertatis (ser libre, no esclavo), el Status Civitatis (ser ciudadano romano, no extranjero), y el Status Familiae (ser jefe de familia, no estar bajo el poder de otro).

💡 Dato clave: Si perdías cualquiera de estos tres estatus, perdías derechos. Esto se llamaba Capitis Deminutio y podía ser máxima (perder la libertad), media (perder la ciudadanía), o mínima (perder tu posición familiar).

Los romanos también reconocían personas morales - organizaciones sin cuerpo físico pero con derechos legales. Estas podían ser asociaciones (grupos de personas con objetivos comunes) o fundaciones (organizaciones para fines de interés general).

La esclavitud era una realidad brutal del derecho romano. Los esclavos eran considerados cosas, no personas, ya fuera por nacer de padres esclavos o por circunstancias posteriores al nacimiento.
